Benchmarking.NYC confirms whether your building is covered by Local Law 88, coordinates the licensed professionals who complete and attest to the work, and files the report with DOB.

Request an LL88 Review

Local Law 88 requires owners of covered New York City buildings to bring lighting up to the NYC Energy Conservation Code and to measure electricity in large tenant spaces with sub-meters. The work deadline was January 1, 2025, and buildings that have not yet shown compliance still need to file a report with the Department of Buildings (DOB).

Benchmarking.NYC confirms what the law requires for your building, coordinates the work and the professional attestations, and submits the LL88 report.

Who Must Comply With Local Law 88?

Based on Department of Finance records, covered buildings are:

  • A building over 25,000 gross square feet
  • Two or more buildings on the same tax lot that together exceed 100,000 gross square feet
  • Two or more condominium buildings governed by the same board of managers that together exceed 100,000 gross square feet

One-, two- and three-family homes and garden-style apartments are not covered buildings. Residential buildings and landmarked buildings that meet the size thresholds are not exempt.

Local Law 88 Lighting Requirements

By January 1, 2025, lighting systems in covered buildings had to meet the NYC Energy Conservation Code standards for new systems. Lighting upgraded after July 1, 2010 that met the code in effect when it was installed already complies. The upgrade covers the entire building, including tenant spaces under 5,000 square feet. Lighting inside dwelling units in occupancy groups R-2 and R-3, and occupancy group A-3 space within a house of worship, is exempt.

Sub-Metering Requirements

The electricity used in each covered tenant space must be measured by one or more sub-meters, and tenants must receive monthly statements. A covered tenant space is either:

  • A tenant space over 5,000 gross square feet, on one or more floors, let to the same tenant
  • A floor over 5,000 gross square feet divided among two or more tenants

A space whose electricity is already measured by a meter dedicated only to that space does not need a sub-meter. Dwelling units in occupancy groups R-2 and R-3 are also excepted.

Deadlines, Reports and Penalties

  • Lighting and sub-meter work deadline: January 1, 2025
  • First report deadline: May 1, 2025
  • Buildings not yet in compliance were required to file by May 1, 2026 under 1 RCNY §103-18
  • No lighting report filed: $1,500, assessed each year until filed
  • No sub-metering report filed: $1,500, assessed each year until filed
  • Sub-meters missing: $500 for each covered tenant space, each year until installed

Reports are filed per building in the BEAM portal, and a filing fee applies (DOB set it at $115 for 2025 reports, covering both lighting and sub-metering). The attestations must be signed by a registered design professional, a licensed master electrician or a licensed special electrician.

How We Handle Local Law 88 Compliance

01

Confirm coverage

We check the building against the DOB Covered Buildings List and identify every covered tenant space.

02

Review lighting and meters

We review the existing lighting against the energy code and check which tenant spaces already have dedicated meters or sub-meters.

03

Coordinate the work

Licensed electricians handle any lighting upgrades and sub-meter installations, with permits where DOB requires them.

04

Attest and file

A qualified professional signs the attestations, and we file the report in BEAM with the tenant space list and a sample monthly statement.

What Is Included?

Our Local Law 88 service may include:

  • Confirmation of LL88 coverage from DOB and Department of Finance records
  • Identification of covered tenant spaces over 5,000 gross square feet
  • Review of existing lighting against the NYC Energy Conservation Code
  • Review of existing meters and sub-meters by tenant space
  • Coordination of licensed electricians for upgrades and installations
  • Coordination of attestations by a registered design professional, licensed master electrician or licensed special electrician
  • Preparation of the covered tenant space list
  • A sample monthly tenant statement for the sub-metering report
  • Submission of the lighting and sub-metering reports in BEAM
  • Review of open LL88 penalties on the building
  • Coordination with LL97 reporting where both laws apply

Why Is This Service Important?

LL88 penalties are assessed every year until the building shows compliance, and missing sub-meters are fined for each covered tenant space. Each year without a filed report adds another penalty.

LL88 also affects Local Law 97. Owners who want to claim good faith efforts to reduce LL97 penalties must attest that lighting upgrades and tenant sub-meters are complete.

Our Service Is Designed For:

  • Property owners
  • Managing agents
  • Commercial landlords
  • Co-op and condo boards
  • Owners of multi-tenant office and retail buildings
  • Facilities teams
  • Owners who missed the LL88 filing deadline
  • Owners preparing LL97 good faith efforts documentation

Why Choose Benchmarking.NYC?

Benchmarking.NYC treats LL88 as part of the building's full Local Law record. We connect the lighting and sub-metering filing to LL84 benchmarking and LL97 reporting, coordinate the licensed electricians and attesting professionals, and file the report so the building's record matches the work that was done.
